These Terms of Service ("Terms") govern your access to and use of the social media platform, website, and applications (collectively, the "Service") provided by showandtell.media ("Company," "we," "us," or "our"). 3. Content can only be posted by a human. Using bots to post content is prohibited.

D. Content Moderation: We reserve the right, but are not obligated, to remove or modify any User Content that we believe violates these Terms or is otherwise objectionable.

4. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Violating any applicable law or regulation.
• Infringing upon the rights of others, including intellectual property rights.
• Transmitting any harmful, threatening, abusive, defamatory, or obscene content.
• Posting pornographic content or criminal activity.
• Interfering with or disrupting the integrity or performance of the Service.

• Using the Service for any commercial purpose without our express written consent.
• Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.

• Using bots to post content.

5. Intellectual Property

All content, trademarks, service marks, logos, and other intellectual property displayed on the Service, excluding User Content, are the property of showandtell.media or its licensors. You may not use, reproduce, distribute, or create derivative works from any content on the Service without our express written permission.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SHOWANDTELL.MEDIA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

8. Indemnification

You agree to indemnify, defend, and hold harmless showandtell.media and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your breach of these Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the state and federal courts located in New Castle County, Delaware for the purpose of litigating all such claims or disputes.
